JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-12-2018 The present writ petition has been filed for quashing the merit list issued by the Sub-Divisional Officer, Sadar (Rural) Motihari, District-East Champaran, which has been published for the purpose of allotment of P.D.S. shop in Chelaha Panchayat under Banjaria Block, East Champaran on the ground that both the seats of Chelaha Panchayat have been arbitrarily reserved for Extremely Backward Caste whereas it should have been otherwise.
The learned counsel for the petitioner submits that while issuing the merit list, objections have been called for and the petitioner has already filed an objection dated 08.09.2018 which is still under consideration since the final P.D.S. license
Patna High Court CWJC No.23752 of 2018(2) dt.19-12-2018 2/2 has not been allotted in favour of anyone.
Having regard to the facts and circumstances of the case, the respondent no. 4 i.e. the Sub-Divisional Officer, Sadar (Rural), Motihari, East Champaran, is directed to consider the objection of the petitioner and pass a final and reasoned order within a period of four weeks from today.
It is needless to state that till the passing of the final order by the respondent no. 4 on the objection filed by the petitioner herein, no allotment shall be made with regard to the license in question regarding the connected location. (Mohit Kumar Shah, J) S.Sb/- U
