====================================================== CORAM: HONOURABLE MR. JUSTICE MADHURESH PRASAD ORAL ORDER 25-07-2023 Heard learned counsel for the petitioner, learned counsel for the Bihar Staff Selection Commission (for short 'BSSC') and learned counsel for the State.
2. The petitioner is aggrieved by his non -selection as a City Manager. He has participated in the process undertaken pursuant to Advertisement No 21010116.
3. The submission is that in the written tests, the petitioner had obtained 25.55 out of 70 marks.
4. A counter affidavit has been filed on behalf of the Respondent Nos. 1 & 2. After filing of counter affidavit, placing on record Resolution dated 16.07.2007 of the Govt. of
Patna High Court CWJC No.1351 of 2020(5) dt.25-07-2023 2/2 Bihar in the Personnel and Administrative Reforms Department (Annexure-A to the counter affidavit), it is apparent that the cutoff marks for the backward class category, of which the petitioner is a member, was 36.5%. The petitioner, admittedly is having less than cut-off marks. Thus, in the opinion of this Court, petitioner can have no grievance about his non- inclusion in the select list.
5. The writ application is, therefore, devoid of merit and dismissed.
