Heard learned counsel for the petitioners and learned counsel representing the State.
Since a limited prayer has been made at this stage on behalf of the petitioners, this writ application is being disposed off taking into consideration the submissions on behalf of the petitioners without going into the merit of the contentions. It appears that the petitioners have been served with a notice calling upon them to remove unauthorized constructions. A copy of the notice is available at Annexure-1 to the writ application. Pursuant to receipt of the said notice, petitioners have represented to the Sub-Divisional Officer-cum-Special Officer, Agriculture Produce Marketing Board (under
10/11 dissolution), Biharsharif. Copies of the representations made by the petitioners is available at Annexure-4 series to the writ application.
Learned counsel for the petitioners submits that even without considering the representations and the stand of the petitioners, the Sub-Divisional Officer, Biharsharif (Nalanda) who is also the Special Officer of the Agriculture Produce Marketing Board (under dissolution) is taking steps to remove the structures which are allegedly unauthorized structures. It is submitted that before taking any such action in terms of the Annexure-1, the Sub-Divisional Officer should consider the submissions of the petitioners as contained in Annexure-4 series to the writ application.
Learned counsel for the State is present and submits that a bare perusal of Annexure-1 would show that action has been initiated for removal of unauthorized constructions only, therefore no illegality or infirmity may be found with the action initiated for that purpose.
Having heard learned counsel for the petitioners and learned counsel representing the State, at this stage, this Court would direct the Sub-Divisional Officer-cum-Special Officer, Agriculture Produce Marketing Board (under dissolution),
11/11 Biharsharif to consider the representations of the petitioners as contained in Annexure-4 series to the writ application and pass an appropriate order thereon within a period of 30 days from the date of receipt/production of a copy of this order. Till passing of the order within the aforesaid period, no coercive action shall be taken against the petitioners. Let it be recorded that this Court has not gone into the merit of the contentions and it will be open for the concerned authority to take an independent view of the matter upon considering the representations as contained in Annexure-4 series to the writ application.
