The Petitioner seeks bail in Phulwarisharif P.S. Case No. 947 of 2019 registered for the offence punishable under Section 395 of IPC.
Prosecution story in brief is that on 15.10.2019 petitioner along with FIR named accused armed with weapons entered the house of Informant in the midnight and after tying the hands and legs of the family members looted Rs. 10 Lac cash and jewellery.
It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case on the basis of suspicion only. Petitioner is not named in the FIR. It has
Patna High Court CR. MISC. No.6366 of 2020(3) dt.03-06-2020 2/2 been further submitted that on the information of Spy that petitioner was seen roaming in the locality on the date of occurrence has been arrested in this case. Petitioner is in custody since 29.10.2019.
Considering the fact that on the confession of petitioner looted cash and jewellery has been recovered, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected. However, the trial court is directed to expedite the trial of the petitioner and conclude the same within a period of one year from the date of receipt/production of a copy of this order.
