The petitioner seeks bail in anticipation of his arrest in connection with Khajauli P.S. Case No. 22 of 2019/CRI No. 312 of 2019 dated 19.02.2019 instituted for the offences under Sections 419, 420, 467 and 468 of the Indian Penal Code.

It has been alleged in the FIR by the concerned Block Co-operative Officer, Kaluahi Block that despite one Barun Kumar Singh having been elected as president of Pal Mohan PACS of which the petitioner

Patna High Court CR. MISC. No.4214 of 2020(11) dt.09-08-2021 2/3 was the erstwhile Chairman, the necessary official documents were not handed over to him. It was also found that some of the account holders, 26 in number, were not returned their amount which indicated towards financial irregularities by the petitioner in his capacity as Chairman of the concerned PACS.

Ms. Mishra, learned counsel for the petitioner has submitted that the accusation, if at all is existent, is with respect to not handing over the documents. It has been submitted that all the documents have now been handed over to the newly elected Chairman of the PACS. There is no complaint whatsoever by anyone of the account holders of their money not having been returned.

It has further been submitted that before lodging this case, necessary sanction of the cooperative authorities had to be taken.

Considering the aforenoted grounds, the petitioner is directed to be released on bail, in the event

No.4214 of 2020(11) dt.09-08-2021 3/3 of his arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate- 3rd , Madhubani in connection with Khajauli P.S. Case No. 22 of 2019/CRI No. 312 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
