Mr.Parmanand Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-01-2020 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek regular bail in connection with Manjhagarh P.S. Case No.237 of 2019 for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 30.42 liters of illicit wine from near the Karbala situated at village Ghamandipur and the petitioners and the other accused persons are stated to have been identified by the Chowkidar, as the culprits who had fled away.

The learned counsel for the petitioners has submitted that

Patna High Court CR. MISC. No.85730 of 2019(2) dt.14-01-2020 2/2 the petitioners have been falsely implicated in the present case. It is further submitted that the petitioners are having a clean antecedent and are languishing in custody since 18.11.2019 and 20.11.2019 respectively.

Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioners, I deem it fit and proper to direct for release of the petitioners on regular bail.

Accordingly, the petitioners, above named, are directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II Cum Special Judge, Excise, Gopalganj in connection with Manjhagarh P.S. Case No. 237 of 2019.
