The petitioner in the present case is seeking regular bail in connection with Lakhisarai P.S. Case No. 660/2019 registered under Section 30(a) of Bihar Prohibition & Excise Act, 2016 pending in the court of learned Additional District & Sessions Judge - II - cum - Special Judge (Excise), Lakhisarai. Learned counsel for the petitioner submits that the owner of the pick-up van is said to have been named this petitioner as driver of the vehicle on which 450 liters of foreign liquor have been recovered. Learned counsel submits that petitioner has been falsely implicated in this case. Learned A.P.P. for the State has opposed the prayer for bail.

No.84930 of 2019(2) dt.09-01-2020 2/2 Considering the facts and circumstances of the case wherein the owner of the pick-up van is said to have been named this petitioner as driver of the vehicle on which 450 liters of foreign liquor have been recovered and further that the petitioner has been allegedly involved in this offence during the period when he was on bail in a case of similar nature, I am not inclined to grant regular bail to the petitioner at this stage as he has been in custody only since 17.11.2019.
The prayer for regular bail of the petitioner is refused. He may however renew his prayer for bail after a reasonable period of custody.
