This application is for grant of anticipatory bail in connection with Rautara P.S.Case No.48 of 2017 for the offences under Sections 366(A) of the Indian Penal Code. Allegation against the petitioner is about kidnapping of the minor daughter of the petitioner. It further appears that she is still traceless.

Submission of the learned counsel for the petitioner is that there are love affair between the parties and she married with the petitioner and residing with him. On the other hand the learned A.P.P. has opposed the prayer for bail on the ground that the girl is minor and she is still traceless..

No.85257 of 2019(2) dt.07-01-2020 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner , however, while considering the prayer for regular bail of the petitioner, if the girl has appeared and her statement has been recorded under Section 164 Cr.P.C. that will be considered by the learned court below.

With the aforesaid observation, this application is dismissed.
