The petitioner seeks regular bail in connection with Dinara P.S.Case No.138 of 2019 registered for offences punishable under Sections 498(A) of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act.
Case is under Section 498A of the IPC and earlier the matter was referred to the Mediation Centre, vide order dated 17.1.2020 . It further appears that the mediation report is available on the record which shows that the settlement has been reached between the parties on payment of Rs.2.10 lac through bank draft, which will be handed over the O.P.no.2 (wife) on the day of decree of divorce by the learned Family court and
Patna High Court CR. MISC. No.85157 of 2019(3) dt.06-03-2020 2/2 signature of both the parties and their lawyer is also available on the meditation report and the memorandum of agreement. Learned counsel for the petitioner is present and supported the agreement reached between the parties. Nobody appears on behalf of the O.P.no.2 (wife). Heard learned A.P.P. and perused the record.
Having heard both sides and considering the fact that the matter has been settlement between the parties, the provisonal bail granted to the petitioner, vide order dated 17.1.2020 is confirmed on the condition that he will abide by the conditions as mentioned in the memorandum of the agreement.
Let a copy of the mediation report along with the memorandum of agreement be sent to the learned court below for the needful.
Accordingly, this application is allowed.
