This application is for grant of regular bail in connection with Suryagarha P.S.Case No.17 of 2017 for the offences under Section 30(a) , 32(c)/38(D) of the Bihar Prohibition and Excise Act, 2016.

There is recovery of huge quantity of liquor from a truck and the apprehended person disclosed the name of the petitioner as the accomplice in the liquor business along with the other accused persons. It further appears that the petitioner is accused in five other cases of similar nature. Submission of the learned counsel for the petitioner is that out of five cases he is been acquitted in two cases and moreover he has been made accused only on confessional statement and nothing has been recovered from his

Patna High Court CR. MISC. No.85891 of 2019(3) dt.19-02-2020 2/2 possession. He is in custody since 23.9.2019 Heard learned A.P.P. who has opposed the prayer for bail..

Having heard both sides and considering the allegation and the antecedent at this stage I am not inclined to grant bail to the petitioner .

With the aforesaid observation, this application is dismissed.
