The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 363,366A,504 and 506/34 of the IPC and Section 8 of the POCSO Act.
The prosecution case as per the written report of Shiv
Patna High Court CR. MISC. No.83988 of 2019(2) dt.18-12-2019 2/3 Shankar Bharti submitted to the SHO, Dhoraiya Police Station is to the effect that on 25.1.2019 at 7.30 A.M., the minor daughter of the informant, namely, Manisha Kumari went to take tuition but she did not return. Ultimately, during search the informant came to know that she has been enticed away by Sintu Kumar. When the informant went to complain, the petitioners being father, uncle, cousin brother and friends abused the informant.
It is submitted by learned counsel for the petitioner that the thrust of accusation is against co-accused Sintu Kumar. Statement has been made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent. Learned APP submits that the petitioners are named in the FIR with specific accusation.
Considering the thrust of accusation against coaccused Sintu Kumar and the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Additional Sessions Judge-cum-Special
