JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 The petitioner seeks regular bail in connection with Patori P.S. Case No. 415 of 2019, registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 217 litres of liquor from a truck and it is alleged that petitioner is also engaged in the liquor trade.

It has been submitted on behalf of the petitioner that he has no criminal antecedent and has falsely been implicated in this case. Further submission is that nothing has been recovered from the possession of the petitioner and the truck, from which, the recovery was made does not belong to the petitioner and he has been in judicial custody since 28.10.2019. Heard learned A.P.P. also.

Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II-cum Special Judge, Excise Act, Samastipur, in connection with Patori P.S. Case No. 415 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
