In this case, the petitioners are seeking anticipatory bail in connection with Amarpur P.S. Case No.372 of 2019 registered for offence punishable under sections 324, 307/34 of the Indian Penal Code and 3/4 of the Explosive Substance Act. It has been alleged that on account of land dispute, the accused persons came at the door of the house of informant and started abusing. On protest, one of the associates, namely, Vivek Yadav took out bomb from his pocket and threw towards informant and his family members, on that account, the informant and his wife and son received serious injury and they were admitted in the hospital.

Patna High Court CR. MISC. No.86051 of 2019(3) dt.20-02-2020 2/2 The learned counsel for the petitioners submits that they themselves were preparing bomb which was exploded accidentally, but the FIR shows otherwise, making allegation against them.

Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioners and accordingly their prayer for bail is rejected. However, if the petitioners surrender before the court below and pray for regular bail, the court below without being prejudiced by this order will take decision in accordance with law.
