Grievance of the petitioner in the present writ application is payment of arrears of salary from November, 2016 to April, 2018 and from April, 2019 till date. No work is gratuitous. Taking work and denying payment amounts to beggari. Beggari in any form is prohibited under the Constitution.

Patna High Court CWJC No.25774 of 2019(2) dt.13-02-2020 2/2 Considering the aforesaid, the writ petition is disposed of with a direction to the respondents to verify record to ascertain whether the appointment is legal and valid and whether the petitioner has actually worked for the aforesaid period or not?

In the event, the appointment of the petitioner is found legal and valid and the petitioner has worked for the aforesaid period, the respondents shall under personal obligation to ensure payment of salary to the petitioner within a period of sixty days from the date of receipt/production of a copy of this order. It shall be open for the petitioner to approach the respondents authority for payment of salary for any other period which is not mentioned in the writ application. With the aforesaid, the writ application stands disposed of.
