By filing supplementary affidavit, the petitioner has brought on the record his criminal record which was not earlier stated in paragraph-3 of the bail petition.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302/120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

The FIR of the occurrence of murder is against unknown. Name of the petitioner surfaced in the confessional statement of co-accused Sushil Kumar Chhaparia and coaccused Shyam Nandan Mishra who were already allowed bail

Patna High Court CR. MISC. No.84505 of 2019(2) dt.08-01-2020 2/2 by a coordinate Bench of this Court. Considering the aforesaid fact co-accused Ashutosh Kumar @ Ashutosh Kumar Shahi was allowed anticipatory bail by this Court in Cr. Misc. No.71355 of 2019.

Hence, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court-below where the case is pending in connection with Town Police Station Case No. 696 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
