In this case, the petitioners are seeking anticipatory bail in connection with Supaul P.S. Case No.425 of 2019 registered for offence punishable under sections 341, 323, 379, 386 and 506/34 of the Indian Penal Code.

Allegation has been made that when the informant was standing at his door along with others, the petitioners and other accused went there, demanded Rs.1,00,000/-forcibly as rangdari and snatched Rs.20,000/- from his pocket and put the pistol on his parietal region.

The learned counsel for the petitioners submits that it

Patna High Court CR. MISC. No.85738 of 2019(3) dt.24-02-2020 2/2 is an improbable story, as petitioner no.1 is father and petitioner no.2 is his son and they have not demanded any ransom amount. The petitioner no. 2 has criminal history.

Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioners and accordingly their prayer for bail is rejected. However, if the petitioners surrender before the court below and pray for regular bail, the court below without being prejudiced by this order will take decision in accordance with law.
