JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-01-2020 This is an application for grant of anticipatory bail in connection with Bidpur P. S. Case No. 71 of 2019, disclosing offences under Sections 341, 323, 326, 307, 379, 504, 506 and 34 of IPC.
As per F.I.R. the petitioner and other accused persons caught hold of the informant, forcibly taken her towards the Banana field and snatched away Rs.25000/- and a golden chain from him. There is specific allegation against this petitioner is of firing along with one Mannu Mahto on the assertion of coaccused Kamlesh Singh. It appears that firing does not hit anybody.
Submission of the learned counsel for the petitioner is that the F.I.R. itself shows that the fire does not hit anybody. Heard learned A.P.P. also, who has opposed the prayer
Patna High Court CR. MISC. No.84292 of 2019(2) dt.21-01-2020 2/2 for anticipatory bail on the ground that petitioner and other accused persons forcibly taken the informant in the Banana field and thereafter, a fire was also made by this petitioner. Having heard both sides, in view of the allegations, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender and pray for regular bail.
