The petitioner seeks regular bail in connection with Charpokhari PS case no. 84 of 2017 instituted for the offence punishable under Section 394 of Indian Penal Code. The allegation is regarding three unknown miscreants having chased the informant and after apprehending him, had snatched his motorcycle and fled away. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case, his name has transpired in the present case on account of confessional statement made by the co-accused person namely Baja @ Kush Kumar. It is further submitted that neither any recovery has been made from the petitioner nor any

Patna High Court CR. MISC. No.85101 of 2019(2) dt.20-12-2019 2/2 T.I. parade has been conducted so as to implicate the petitioner in the alleged crime. Lastly, it is submitted that the petitioner is languishing in custody since 01.10.2019.

Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Bhojpur, Ara in connection with Charpokhari PS case no. 84 of 2017.
