JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 This is an application for grant of anticipatory bail in connection with Raniganj P. S. Case No. 208 of 2019 disclosing offences under Sections 147, 149, 341, 323, 324, 325, 379, 354B, 435, 504, 506, 34 of the Indian Penal Code. Prosecution case is that petitioner and other accused persons assaulted the informant and specific allegation against one Mustakim @ Ghotal that he started to pull her after catching her hairs, when he came to save her, accused persons assaulted her husband by lathi and danda. There is also allegation against other accused persons of assault causing injury. Further allegation of taking of Rs.10,000/- and setting the straw house of the informant on fire. Submission of the learned counsel for the petitioners is that except petitioner no.1, there is no specific allegation has been attributed against any of the petitioners and the injuries attributed by petitioner no.1 to the mother of the informant was found to be simple in nature. There is case and counter case between the parties.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned S.D.J.M. Araria, in connection with Raniganj P. S. Case No. 208 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/-
