Mr.Bharat Lal ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-01-2020 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Ahiyarpur P.S. Case No. 942 of 2019 for the offences punishable under Sections 447, 341, 323, 307, 379/34 of the Indian Penal Code and Section 27 of Arms Act. The allegation is regarding the accused persons including the petitioner herein having arrived at the house of the informant and having engaged in assaulting the informant. It is further alleged that the petitioner had snatched gold chain of the wife of the informant and had also taken away some cash amount. It is further alleged that co-accused person, namely, Ravi Kumar had fired on the son of the informant resulting in

The learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in the present case. It is stated that as far as the petitioner is concerned, there is no allegation of any sort of assault on the informant or his family members. It is also stated that the petitioner is having a clean antecedent and is languishing in custody since 09.08. 2019.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the fact that there is no allegation of assault as far as the petitioner is concerned, I deem it fit and proper to grant regular bail to the petitioner. Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S.
