This application is for grant of regular bail in connection with Bidupur P.s.Case no.310 of 2019 for the offences under Sections 302, 120(b)/34 of the Indian Penal Code and Section 27 of the Arms Act.

Case is of double murder and petitioner was seen fleeing away from the place of the occurrence along with the other accused persons.

Submission of the learned counsel for the petitioner is that there is no eye witness of the occurrence and the enmity is with Abhishek Kumar and Vivek Kumar and as he happens to be friend of Abhishek Kumar and Vivek Kumar he has been falsely implicated in this case and he is in custody since 2.8.2019.

Patna High Court CR. MISC. No.87175 of 2019(4) dt.25-02-2020 2/2 Heard learned A.P.P. and the learned counsel for the informant, who has opposed the prayer for bail on the ground that he was seen fleeing from the place of occurrence and the same has also come during the investigation. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner .

Accordingly, this application is dismissed.
