The petitioner in the present case is seeking anticipatory bail in connection with Korha P.S. Case No.443 of 2018 registered for the offence punishable under Sections 341, 323, 379, 307, 504 and 506/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Learned counsel submits that there is no specific allegation against the petitioner.
Learned APP has opposed the prayer for bail.
Considering the facts and circumstances of the case wherein the allegation against the petitioner is that of giving an assault on the head of the informant by a Dabiya and that caused
Patna High Court CR. MISC. No.2847 of 2020(3) dt.23-01-2020 2/2 head injury, this Court is not inclined to grant anticipatory bail to the petitioner.
Learned counsel for the petitioner has submitted that the petitioner is 77 years old, there is a case and counter case between the parties and about the head injury opinion is still reserved. In case, the petitioner surrenders and prays for regular bail in the court below within a period of four weeks from today, his prayer for regular bail shall be considered keeping in view the materials available on the record and the submission of the petitioner as noticed above.
