The petitioner seeks bail in anticipation of his arrest in connection with Madanpur P.S. Case No. 136 of 2014, dated

19.07.2014, instituted for the offences under Sections 147, 148, 149, 341, 323, 337, 353, 307 and 124-A of the Indian Penal Code, Section 27 of the Arms Act, Section 3/4 of the Explosive Substances Act, 1908 and Section 17 of the Criminal Law Amendment Act, 1932.

It appears that there was an attack on the police picket by the members of a maoist outfit. There were about one thousand persons in the crowd. The police swung into action and arrested sixteen miscreants on the spot, whose names have been given in the F.I.R. The petitioner has been made accused in this case only on the basis of suspicion and that also after five years of the lodging of the F.I.R.

Under similar circumstances, one of the accused persons has been granted anticipatory bail by a Bench of this Court in Cr. Misc. No. 1122 of 2019 on 17.01.2019.

The petitioner claims to be a person of clean antecedent. Considering the facts afore-stated, the petitioner abovenamed, in the event of his arrest/surrender before the Court below within a period of eight weeks from today, is directed to

be released on bail on his furnishing bail-bond in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection Madanpur P.S. Case No. 136 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
