2. Petitioner seeks bail, who is in custody since 17.09.2025, in connection with Muffasil P.S. Case No. 585 of 2025, F.I.R. dated 10.09.2025 registered for the offences punishable under Sections 137(2), 96, 3(5) of the B.N.S. and Section 8 of the POCSO Act.

3. Allegation against the petitioner is that he has kidnapped the minor daughter of the informant and sexually assaulted her.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.91548 of 2025(2) dt.13-01-2026 2/2 petitioner has clean antecedent and he has been falsely implicated in the present case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offence as alleged in the F.I.R.

5. Learned APP for the State, on the other hand, vehemently opposed the prayer for bail of the petitioner and submits that the petitioner has kidnapped the daughter of the informant and later on the daughter of the informant has been recovered and her statement was recorded under Section 164 of the Cr. P.C./183 of B.N.S., 2023 in which she has categorically stated that the petitioner has abducted her and he has forcefully established physical relation with her.

6. Considering the aforesaid facts that there is direct and specific allegation against the petitioner, I am not inclined to enlarge the petitioner on bail in connection with Muffasil P.S. Case No. 585 of 2025 pending in the Court of learned 6th District & Additional Sessions Judge-cum-Exclusive Special JUdge, POCSO Act, East Champaran, Motihari.

7. Prayer is refused.
