JUSTICE ARVIND SRIVASTAVA ORAL ORDER 04-02-2020 Learned counsel for the petitioners submits that the petitioner No.1 has been taken into custody, therefore, this application with respect to petitioner No.1 has now become infructuous.
Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Lakhisarai (Kabiya) P.S. Case No. 627 of 2019 for the offence punishable under Sections 406, 420, 504 and 34 of the Indian Penal Code.
Learned counsel appearing for the petitioners submits that he is ready to pay the amount in question to the informant for which entire dispute has been arisen between
Patna High Court CR. MISC. No.2016 of 2020(5) dt.04-02-2020 2/2 the parties and, accordingly, he handed over a draft of Rs. 5,00,000/- bearing No.001535 dated 01.02.2020 issued by the HDFC Bank Ltd. to the counsel for the informant. Now nothing remains in this case for further prosecution against the petitioners. Hence, the petitioners may be granted the privilege of anticipatory bail.
Learned counsel for the informant does not dispute the same and accepted the aforesaid draft of the alleged amount.
Considering the facts and circumstances of the case, let the, above named, petitioners in the event of their arrest or surrender before the court below within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Lakhisarai in connection with Lakhisarai (Kabiya) Case No. 627 of 2019 subject to the conditions laid down under Section 438(2) of the Cr.P.C.
