2. The instant writ application has been filed for the following relief(s):- "(A) A writ in the nature of mandamus for commanding and directing the respondent specially respondent No.3 to disposed of Encroachment Case No.

02/2002-03 in the light of order passed in Encroachment Appeal Case No. 06/2003-04 (Maqbool Ahmad versus State of Bihar) by learned Collector-cum-District Magistrate, Patna on 10.04.2015.

(B) Any other relief to which the

Patna High Court CWJC No.698 of 2026(2) dt.24-07-2026 2/2 petitioner is entitled under the facts and circumstances of this case. "

Learned counsel for the petitioner submits that Encroachment Case No. 02/2002-03 is pending since last 24 years and during interregnum period, the appeal was preferred and then it was remanded to the Land Reforms Deputy Collector, Patna City, which is still pending and no final conclusion has been drawn as yet.

4. Considering the fact that the aforementioned Encroachment Case No. 02/2002-03 is pending since last 24 years, the Land Reforms Deputy Collector, Patna City is directed to dispose of the same after giving hearing to all concerned as is provided under the Bihar Public Land Encroachment Act, 1956, and necessary orders shall be passed, adjudicating the issues, in question within the period of three months from the date of representation filed by the petitioner along with the copy of the order passed in this case.

5. The writ petition stands disposed of with the aforesaid observation and direction.
