JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 18-06-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Paras Bigha P.S. Case No. 86 of 2018 for the offence under Sections 302 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner would submit that the petitioner has earlier approached this Court for grant of anticipatory in Cr. Misc. No. 68597 of 2019 which was rejected by order dated 25.10.2019. Learned counsel submits that the petitioner was not named in the FIR and he has been roped in the case only on the basis of confessional statement of co-accused Raju Kumar @ Raj Kishore. He further submits that accused persons, namely, Raj Kishor Kumar @ Raju Kumar and Rajesh Kumar, who have been made accused

Patna High Court CR. MISC. No.86441 of 2019(4) dt.18-06-2020 2/2 in the case, have been granted regular bail by this Court in Cr. Misc. No. 72107 of 2018 and Cr. Misc. No.73385 of 2018, respectively. Petitioner is in custody since 14.11.2019. In order to maintain consistency, the Court is inclined to grant bail to the petitioner. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in connection with Paras Bigha P.S. Case No. 86 of 2018, subject to the condition that on release, the petitioner shall render his service as volunteer in the District Health Centre for a period of one month in dedicated Covid hospital. He is required to report the District Nodal Officer in the concerned region who shall utilise the service of the petitioner appropriately.
