The petitioner, who is the husband of opposite party no. 2, seeks bail in anticipation of his arrest in connection with Mohiuddin Nagar P.S. Case No. 99 of 2019 dated 12.06.2019 instituted for the offences under Sections 341, 323, 504, 498-A and 34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
Mr. Rana Sanjay Kumar Singh, learned counsel for the petitioner at the outset has stated that the spouses have settled their differences and in fact daughter of opposite party no. 2 is residing under the
Patna High Court CR. MISC. No.86133 of 2019(7) dt.12-01-2021 2/2 same roof with the petitioner as man and wife. Considering the aforesaid submission on behalf of the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Samastipur in connection with Mohiuddin Nagar P.S. Case No. 99 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C. The Court while granting bail to the petitioner shall have it confirmed that the daughter of opposite party no. 2 is residing with the petitioner as his legally wedded wife.
The petition stands disposed of accordingly.
