Mr.Ahmad Ali ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 17-06-2020 Heard Mr. Shyamal Prakash, the learned counsel for the petitioner and Mr. Ahmad Ali, the learned Additional P.P. through video conferencing.

The petitioner apprehends his arrest in Parwalpur P.S. Case No.254 of 2019, registered under Sections 341, 323, 308, 379, 504 and 506 of the Indian Penal Code.

The informant in sum and substance alleged that while he was cleaning his drainage, the petitioner came and asked him not to throw water in the drain. When the informant objected, the petitioner picked up quarrel and began to abuse and assaulted the informant. Ravikant Kumar, the son-in-law of the informant, cam to save the informant but the petitioner also assaulted him with a piece of brick and the son-in-law of the informant became unconscious.

Learned counsel for the petitioner submits that the petitioner and the informant are next door neighbour. Some dispute arose due to cleaning of drainage and on account of such

Patna High Court CR. MISC. No.83974 of 2019(3) dt.17-06-2020 2/2 only some scuffle took place. There is no criminality in the behaviour of the petitioner. From perusal of the case diary and the injury report of the son-in-law of the informant, it would appear that some reddish mark was found on the back of the son-in-law of the informant. The injury is quite simple and superficial in nature. The informant did not get any injury.

Taking into consideration the facts that on account of cleaning of drainage, there is scuffle between the informant and the petitioner and the son-in-law of the informant of course got one abrasion on the back but the same is superficial and simple in nature, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 1st, Hilsa, Nalanda in connection with Parwalpur P.S. Case No.254 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
