2. The petitioner seeks bail in connection with Chakmehsi P.S. Case No. 133 of 2025 registered for the offence under Sections 109(1), 121(2), 132, 317(5) , 319(2), 3(5) of the BNS and under Sections 25(1-b)a, 26, 27, 35 of the Arms Act.

3. As per the prosecution case, the petitioner and others were caught with one country made pistol and some live cartridges and they are alleged to have fired upon the police.

4. The petitioner is in custody since 21.08.2025 and he is accused in four more cases.

5. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case on the basis of the criminal antecedents of the

6. Considering the nature of allegation levelled against the petitioner and the period of custody of the petitioner, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur/concerned Court below in connection with Chakmehsi P.S. Case No. 133 of 2025.

8. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Saraiya Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) Vikas/- U
