Petitioner is apprehending his arrest in connection with Dhaka P.S.Case No.249 of 2019 , registered for offences punishable under Sections 498A, 341, 323 and 379 of the Indian Penal Code and Section 3⁄4 of the D.P.Act. Petitioner happens to be husband of the informant with allegation of demand of Rs.05 lac and for that assaulting her. Submission of the learned counsel for the petitioner is that he is residing outside India and the allegation is false and moreover father of the informant has filed an informatory petition in the Police Station stating that no such demand was made by the petitioner, which will appear from Annexure-2. Heard learned A.P.P. also.

No.214 of 2020(2) dt.23-01-2020 2/2 Having heard both sides and in view of submissions as made above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Sikrahana at Dhaka, East Champaran in connection with Dhaka P.S.Case No.249 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure . However, it is made clear that if in future genuineness of the annexure-2 is challenged or doubted, the prosecution is at liberty to move for cancellation of the bail bond of the petitioner.
