JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-07-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner seeks bail in connection with Chapra Muffasil Police Station Case No.149 of 2016 registered under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code. The accusation is that Jamabandi No.171 regarding 12 Katha 17 Dhur lands was created in favour of the family of the informant through Jamabandi No.228. Out of 12 Katha 17 Dhur lands, one Katha land was sold to Ramchandra Tiwary regarding which Jamabandi No.1554 was created but remaining 11 Katha 17 Dhur land was shown as Zero by the Halka Karmchari with the conspiracy of the 'Bhu-Mafias' including the petitioner. Learned counsel appearing on behalf of the petitioner submits that vide order dated 11.12.2017 passed by this Court in

Patna High Court CR. MISC. No.87329 of 2019(5) dt.10-07-2020 2/2 Criminal Misc. No.56949 of 2017, in the present case, the petitioner was granted the privilege of pre-arrest bail and, accordingly, he had furnished the bail bond but, later on, the bail bond of the petitioner was cancelled vide order dated 13.02.2019 passed by this Court in Criminal Misc. No.10217 of 2018 due to suppression of some facts. Thereafter, the petitioner surrendered before the court below on 01.10.2019 and since then he is in custody. Moreover, on investigation, the police has already submitted the charge-sheet against the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra, in connection with Chapra Muffasil P.S. Case No.149 of 2016.
