JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-06-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Sessions Trial No. 433 of 2018 arising out of Bhagwan Bazar P. S. Case No.486 of 2017 for the offenses under Sections 396 and 397 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner had earlier approached this Court for bail which was rejected. The other co-accused have been granted bail by a Coordinate Bench of this Court. The petitioner is in custody since 1.12.2017.

Considering the fact that the petitioner is in custody since 1.12.2017, the Court is inclined to grant bail to the

Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the 11th Additional Sessions Judge, Saran at Chapra in connection with Sessions Trial No. 433 of 2018 arising out of Bhagwan Bazar P. S. Case No.486 of 2017, subject to the condition that the petitioner shall remain present in the court proceedings on all the dates.

The Court below is directed to conduct the trial on day to day basis and conclude the same within a period of six months.

In the event there is any lapse on the part of the petitioner in conclusion of the trial, the court below shall be at liberty to cancel his bail bond.
