The instant application has been filed, seeking initiation of a contempt proceeding against the opposite parties for their wilful and deliberate disobedience of the order dated 16.01.2025 passed in CWJC No. 1692 of 2025, whereby the Court while directing the District Magistrate, Muzaffarpur to consider the representation of the petitioner and pass a reasoned and speaking order, observed that if the claim of the petitioner for interest over the delayed payment finds favour, necessary payment shall be made within the period stipulated.

3. A show cause affidavit has been filed bringing on record the detailed reasoned order passed by the District Magistrate, Muzaffarpur as contained in Memo No. 506 dated 14.03.2026. It is categorically submitted that on being found no delay on the part of the concerned opposite parties, the claim for statutory interest on the delayed payment has been rejected.

Learned Advocate for the petitioner submitted that the claim of the petitioner for interest over the delayed payment was required to be considered in the given facts and circumstances of this case, but the same has not been done and as such it is not the compliance of the order of this Court, in its letter and spirit.

5. Be that as it may, considering the fact that the

Patna High Court MJC No.4169 of 2025 dt.03-07-2026 3/3 detailed reasoned order has been passed negating the claim of the petitioner, this Court does not find any reason to continue with the present proceeding. Accordingly, the present contempt petition stands closed, with liberty to the petitioner to assail the order if he feels aggrieved.
