ANJANA MISHRA ORAL ORDER 20-12-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Udakishunganj P.S. Case No.176 of 2019 registered for the offence punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. but subsequently, during the course of investigation on the basis of the confessional statement made before the police by one Sandeep Sah alias Chunmun Sah, he is now facing prosecution. It is further submitted that the petitioner has got no criminal antecedents. Considering the aforementioned facts and

Case No.176 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
