The petitioner seeks regular bail in connection with Barh PS case no. 237 of 2014 instituted for the offence punishable under Sections 324, 307/34 of Indian Penal Code and Section 27 of Arms Act.
The allegation is regarding the petitioner and the co-accused person namely Ravi Shanker Vidhyarthi having met at the shop of the informant, whereafter the co-accused person had fired upon the son of the informant resulting in injuries on his buttock, however the gun shot fired by the petitioner did not hit the son of the informant.
The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the
Patna High Court CR. MISC. No.86736 of 2019(2) dt.16-01-2020 2/2 present case. It is further submitted that the petitioner is accused in one other case but he is on bail in the said case. The petitioner is said to be languishing in custody since 26.08.2019. Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner coupled with the fact that the gun shot injury is said to have been caused by the co-accused person and the petitioner is having a clean antecedent, I deem it fit and appropriate to release the abovenamed petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st, Barh, Patna in connection with Barh PS case no. 237 of 2014.
