JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-07-2022 After some argument, the learned counsel for the petitioner seeks to withdraw the present petition with liberty to approach the Circle Officer, Motipur, District-Muzaffarpur for the purposes of removal of encroachment made over government land appertaining to Khata No. 716, Khesara No. 4963 situated in village-Saghanpura, P.O. Rampur Bhediahi, P.S. Kathaiya, District-Muzaffarpur which has been encroached

Patna High Court CWJC No.915 of 2020(3) dt.14-07-2022 2/2 by the private respondents by constructing hutment. Liberty so sought is granted.

It is made clear that in case appropriate petition is filed within a period of four weeks from today before the Circle Officer, Motipur, District-Muzaffarpur, necessary action shall be taken in accordance with law as also in accordance with the provisions contained in Bihar Public Land Encroachment Act, 1956, within a period of 12 weeks thereafter. The writ petition stands disposed off on the aforesaid terms.
