The petitioner seeks regular bail in connection with Khagaria Muffasil P.S.Case no.191 of 2019 dated 20.3.2019 arising out of G.R.No.766 of 2019 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016 and Section 25(1-b)a/26 of the Arms Act. . Allegation against the petitioner is about recovery of 08 ltrs. of liquor and one country-made Pistol from the Basa of the petitioner..
Submission of the learned counsel for the petitioner is that he petitioner was not residing in the Basa, which was an open place as such possibility of somebody else keeping of the liquor can not be ruled out. He is in custody for three months.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Spl. Judge, (Excise), Khagaria in connection with Khagaria Muffasil P.S.Case No.191 of 2019 dated 20.3.2019 arising out of G.R.No.766 of 2019.
With the aforesaid observation, this application is allowed.
