2. Petitioner seeks regular bail for the offences punishable under Sections 103(1) and 3(5) of the Bharatiya Nyaya Sanhita .
3 . As per F.I.R. co-accused Laxmi Kumari assaulted on the neck of husband of informant (deceased) by means of brick and this petitioner assaulted him by means of fists and legs, as a result of which husband of informant died.
4. Learned counsel for the petitioner submits that allegation of assault is general and omnibus against this petitioner. As per F.I.R. there is allegation of assault to deceased against co-accused Laxmi Kumari who has already been
Patna High Court CR. MISC. No.91257 of 2025(4) dt.13-05-2026 2/2 granted bail by Co-ordinate Bench of this Hon'ble Court vide order dated 06.05.2026 in Cr. Misc. No. 25735 of 2026 . Petitioner is in custody since 24.09.2025. Chargesheet has already been submitted.
5 . Learned A.P.P. for the State as well as informant opposed the bail application of the petitioner.
6. Considering the aforesaid facts, materials available on record and other circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-Vth Siwan/ concerned Court in connection with Mairwan P.S. Case No. 161 of 2025 .
