JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-12-2019 Petitioners seek bail in anticipation of their arrest in connection with Gopalganj Town P.S. Case No. 267 of 2019 registered for the offences punishable under Sections 420 and 409/34 of the Indian Penal Code.

As per FIR allegation against the petitioners who happen to be Mukhiya and Panchayat Sewak respectively is of misappropriation of Government money allotted for the purpose of Village drinking water supply scheme along with other accused persons.

Submission of learned counsel for the petitioners is that for the aforesaid act petitioners have no role rather the same has to be executed by Ward Implementing Committee and

Patna High Court CR. MISC. No.84398 of 2019(2) dt.19-12-2019 2/2 inquiry report (Annexure-2) also disclosed the same. Heard learned APP also.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj, in connection with Gopalganj Town P.S. Case No. 267 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that they have to co-operate in the investigation.
