The petitioner seeks bail in connection with S. Tr. No. 21 of 2004 arising out of Praiya P.S. Case No. 40 of 2003 registered under Sections 147, 148, 149, 353, 324, 323, 326, 332, 307, 302, 452, 436, 426 and 427 of the Indian Penal Code, 27 of the Arms Act and 3 and 4 of the Explosive Substances Act. The petitioner is named in the first information report on the basis of the paper containing the name of several persons recovered at place of occurrence by the informant and other police personnel.
Submission is that the petitioner has no criminal antecedent and his name has surfaced in the first information report on the basis of the recovery of the paper on spot
Patna High Court CR. MISC. No.9057 of 2020(3) dt.03-06-2020 2/2 disclosing the several names of the culprits and the petitioner is in custody since 27.08.2019.
Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with S. Tr. No. 21 of 2004 arising out of Praiya P.S. Case No. 40 of 2003 to the satisfaction of the Additional Sessions Judge, I, Gaya, subject to the conditions that out of two bailors, one must either be parent or close relative of the petitioner.
