ANJANA MISHRA ORAL ORDER 20-12-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Kahalgaon P.S. Case No.500 of 2019 registered for the offence punishable under Sections 341, 323, 354, 447, 379, 504, 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the entire allegation against the petitioners is false and fabricated and has been initiated on account of old enmity between the parties. It is further submitted that the allegations under Sections 379 and 354 of the I.P.C. are purely ornamental to make the

Considering the allegations carved out in the F.I.R. and that the petitioners are not having any criminal antecedents, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Kahalgaon P.S. Case No.500 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
