JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 19-04-2023 Learned counsel appearing on behalf of the respondent State submitted that a detailed supplementary counter affidavit has been filed on behalf of respondent No.1 the Additional Chief Secretary, Education Department, Government of Bihar that only 10% pension has not been sanctioned to be paid to the petitioner 90 % pension has been sanctioned and Accountant General has taken appropriate action on his behalf to make the payment of the same in the account of the

Patna High Court CWJC No.2174 of 2020 dt.19-04-2023 2/2 petitioner.

2. If the petitioner is aggrieved for non-payment of 10% of pension, allegedly, which has been withhold without any reason and the interest which has accrued on difference of salary payable to the petitioner and benefit of 3rd MACP and other retiral dues for which also petitioner is entitled for, this Court directs the respondent authorities to further sanction the interest accrued on account of delay in payment of retiral dues on different heads within a period of three weeks.

3. The relief as prayed for in the present writ petition is allowed.

4. Accordingly, the present writ petition stands disposed of.
