ANJANA MISHRA ORAL ORDER 20-12-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 12.06.2019 in connection with Khajekalan P.S. Case No.255 of 2019, S.Tr. No.922 of 2019 registered for the offence under Sections 25(1-b)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that the alleged recovery of arms was not from the conscious possession of the petitioner, but the same was saddled on his shoulders that it was recovered from his house. It is further submitted that the petitioner is not having any criminal antecedents.

Considering the aforementioned facts and circumstances and that the petitioner has been in jail for

No.84705 of 2019(2) dt.20-12-2019 2/2 almost six months, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 5th Additional Sessions Judge, Patna City at Patna, in connection with Khajekalan P.S. Case No.255 of 2019, S.Tr. No.922 of 2019.
