2. The petitioner seeks regular bail in connection with Puraini P.S. Case No. 239 of 2024 registered for the offence under Sections 103(1), 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.
3. As per the prosecution case, all the FIR named accused persons including this petitioner surrounded the informant's husband and committed his murder by firing gun shot.
4. Learned counsel for the petitioner submits that informant is not an eye-witness to the occurrence and there is no specific allegation against this petitioner. As per F.I.R., five
Patna High Court CR. MISC. No.89655 of 2025(2) dt.12-02-2026 2/2 persons are alleged to have fired, but as per post-mortem report, only two gun shot injuries have been found on the person of deceased. Similarly situated co-accused Deep Narayan Yadav has been granted bail by a coordinate Bench of this Court, vide order dated 11.09.2025 passed in Cr.Misc. No. 34789 of 2025. Petitioner is in custody since 28.02.2025. Chargesheet submitted.

Considering the aforesaid facts and circumstances and period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Udakishunganj, Madhepura in connection with Puraini P.S.
