Case No. 54 of 2014, registered for the offences punishable under Sections 341, 323, 452, 380, 504, 506 of the Indian Penal Code and Sections 25(1-B)(a), 26 and 35 of the Arms Act. As per prosecution case, petitioner came with loaded gun which was snatched by the informant and petitioner succeeded in fleeing away and the gun was produced before police.

Submission of learned counsel for the petitioner is that there is land dispute between the parties and petitioner is in custody since 21.9.2019 and charge sheet has been submitted, as such there is no chance of tampering with the evidence. Heard learned APP also.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.84380 of 2019(3) dt.20-02-2020 2/2 petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Katihar, in connection with Rautara P.S. Case No. 54 of 2014.
