JUSTICE MADHURESH PRASAD ORAL ORDER 20-06-2023 A recruitment process for appointment of Home Guards was initiated pursuant to advertisement No. 05/19 dated 29.11.2019 (Annexure-7). The writ petitioners have assailed the advertisement and sought a direction that the provision of reservation should be added to the appointment process under
Patna High Court CWJC No.1211 of 2020(3) dt.20-06-2023 2/2 the advertisement.
Learned counsel for the Central Selection Board of Constable (for short "Board") submits that the advertisement is issued as per requisition made by the State Government. The Board abides by the requisition and the Recruitment Rules under which the advertisement is issued. In the instant case, the Recruitment Rules 2017 does not provide for reservation to Home Guards and therefore such provision has not been made. It is further submitted that the process of selection has attained finality on 10.01.2022, when final result was published. By making such submissions, he opposes the prayer made in the writ petition.
The order-sheet reveals that when the matter was last taken up on 04.02.2023, the petitioners' counsel had sought an adjournment. Today when the matter is taken up, there is none to represent the petitioners.
Therefore, without going into merits of the submission advanced by the learned counsel for the Board, petition is dismissed for want of prosecution. (Madhuresh Prasad, J) SUMIT/- U
