The petitioners are apprehending their arrest in connection with Nabinagar P.S. Case No. 304 of 2019 for the offence registered under Sections 20 (b) (ii) (B) of the NDPS Act and under Sections 224, 225, 353/34 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.84322 of 2019(2) dt.19-12-2019 2/3 alleged recoveries were not from the conscious possession of the petitioners and they have been falsely implicated in connection with the present case. It is further submitted that though it is alleged that the petitioners have some connection with Sumer Singh, the contraband items were recovered from the roof top and since the other petitioners are in joint occupation with the said Sumer Singh, these petitioners have also been named along with the Sumer Singh, who is the petitioner no. 1 of the present bail application. Considering the aforesaid facts and circumstances of the case, let the petitioner Nos.
2 to 5, namely, Anil Singh, Yogendra Singh, Anand Singh @ Anand Kumar Singh & Law Singh @ Law Kumar Singh, in the event of their arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge VII cum Special Judge (Excise), Aurangabad in connection with Nabinagar P.S. Case No. 304 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
