JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-02-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Rajiv Nagar P.S. Case No. 373 of 2019 registered for the offences punishable under Sections 341, 342, 323, 354, 307, 379 of the Indian Penal Code.

The accusation against the petitioner is that he tried to outrage the modesty of informant's daughter and also assaulted the informant and her family members.

Submission on behalf of the petitioner is that petitioner had affair with the daughter of informant and as a matter of fact, on the alleged date of occurrence, it was prosecution party, who entered the house of the petitioner and assaulted the family members for which the mother of the

He further submits that so far as injureds of this case are concerned, they have sustained simple injury and some of the co-accused has already been granted anticipatory bail by learned Sessions Judge vide order dated 02.09.2019 passed in ABP No. 5936 of 2019.

On the other hand, learned Additional Public Prosecutor opposes the prayer for anticipatory bail. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Judge-III cum Additional Chief Judicial Magistrate, Patna in Rajiv Nagar P.S.Case No. 373 of 2019 subject to condition as laid down under Section 438(2) of the Cr.P.C.
