JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-01-2020 The petitioner seeks regular bail in connection with Sidhwalia P.S. Case No. 190 of 2019 (Tr. No. 23/2019), registered for offences punishable under Sections 399, 402, 413, 414 of the Indian Penal Code, Sections 25(1-b)A, 26(1)(2), 35 of the Arms Act and Sections 8(c ), 20(b)(ii)(B) of NDPS Act. Prosecution case is that police on information that some miscreants have assembled to commit a crime, raided the place and arrested the petitioner, on whose possession one stolen motorcycle and a mobile as well as a knife was recovered and there is also recovery of country made pistol and ganja from other accused of this case.

It has been submitted on behalf of the petitioner that he has no criminal antecedent and has falsely been made accused in this case and he has been in judicial custody since 16.10.2019.

Having heard both sides, considering the facts and circumstances as well as the fact that petitioner was arrested on spot, I am not inclined to enlarge the petitioner on bail. This application is accordingly dismissed.
